These Terms & Conditions (“Terms”) govern your use of the MoneyClaim website (the “Website”) and any services provided by Infidhan Recovery Solutions LLP (“MoneyClaim”, “we”, “us”). By using the Website, contacting us, or signing an engagement with us, you agree to these Terms. Please read them together with our Privacy Policy and Disclaimer.
1. Who we are and key terms
Infidhan Recovery Solutions LLP is a limited liability partnership under the Limited Liability Partnership Act, 2008, with its registered office at No. 5, 1st Floor, Sri Sachyay Krupa Complex, Hulsur Bazaar, G Street, Jogupalyam, Halasur, Bangalore - 560008, Karnataka, India. In these Terms, “you” means any person using the Website or engaging our services, and “Services” means the services described in section 3.
You must be at least 18 years old and legally capable of contracting to engage us. If you act for someone else (as a legal heir, attorney or representative), you confirm that you have authority to do so.
2. Use of the Website
The Website provides general information about our Services and ways to contact us. You agree to:
- use it only for lawful purposes;
- not attempt to gain unauthorised access to it, interfere with it, or introduce malicious code;
- not copy, scrape or republish its content without our written permission;
- not impersonate any person or misrepresent your relationship with us.
The Website contains links to external portals (for example, MF Central, the RBI’s UDGAM portal and the IEPF Authority). We do not operate them and are not responsible for their content or availability.
3. Our Services
We assist investors and legal heirs with matters such as:
- tracing lost, forgotten or unclaimed shares, bonds, mutual funds, bank deposits and provident fund balances;
- claiming shares and dividends transferred to the Investor Education and Protection Fund (IEPF);
- dematerialisation of physical share certificates;
- transmission of securities to legal heirs or nominees;
- issue of duplicate share certificates and related indemnity and affidavit documentation;
- legal-heir and succession documentation, and KYC or signature corrections with registrars and depositories.
The exact scope, documents and steps for your case will be set out in a written engagement (an email, proposal or engagement letter) agreed with you. If anything in it conflicts with these Terms, the engagement prevails for that case.
Where a matter requires legal advocacy, court proceedings or other regulated work, it will be handled by a suitably qualified professional under a separate arrangement, and we will tell you before any additional cost arises. The free search tools linked on our Website are available to you directly; we only help where you want us to.
4. Our role and your authority
We act on your behalf only to the extent you authorise. For many steps — for example, filing an IEPF claim or approaching a company or registrar — you will be asked to sign forms, affidavits or a limited authorisation. We will explain what each document does before you sign it. You remain the claimant and the beneficial owner; recovered securities or money are credited directly to your own demat or bank account, never to ours.
We do not give investment advice, and nothing we say is a recommendation to buy, sell or hold any security.
5. No guarantee of outcome
Recovery depends on facts and on decisions made by third parties — companies, registrars and transfer agents, depositories, banks, the IEPF Authority, regulators and courts. Records may be incomplete, claims may be rejected or require further documents, and timelines depend on third-party responses. Accordingly:
- we do not guarantee that any investment will be traced or recovered, or the amount, value or time of any recovery;
- any timelines we mention are estimates, not commitments;
- we are responsible for performing our Services with reasonable skill and care — not for decisions of third parties.
6. Your responsibilities
You agree to:
- give us true, complete and current information, and genuine documents — we will not work with forged or altered documents and may stop work and report where the law requires;
- tell us promptly about anything that may affect your case (for example, another claimant, a dispute within the family, or a pending legal proceeding);
- sign and return documents, and respond to requests, in good time;
- keep your own credentials, OTPs and PINs private. We will never ask for them.
You remain responsible for the accuracy of declarations, affidavits and indemnities you sign, and for the tax treatment of anything you recover.
7. Fees, charges and payment
- Consultation. The initial consultation and preliminary guidance are free of charge.
- Our fees. Our professional fees for a case will be communicated and agreed in writing before work starts, and may be fixed, success-linked, or a combination, as stated in the engagement.
- Third-party and statutory costs. Government and regulatory fees, stamp duty, notary and affidavit charges, courier costs, registrar or company charges, and similar out-of-pocket expenses are separate from our fees. We will tell you about them in advance wherever we can.
- Taxes. Goods and Services Tax and other applicable taxes are charged extra where applicable.
- Payment. Invoices are payable as stated in the engagement. We will never ask you to pay into a personal account, and will pay invoices only to the bank account of Infidhan Recovery Solutions LLP shown on our invoices. Please verify before you pay.
- Cancellation. You may end an engagement by written notice. Fees for work already done and costs already incurred remain payable, and any success-linked fee remains payable on recovery of an amount traced through our work.
8. Confidentiality and data protection
We keep your information confidential and use it only for your case and as described in our Privacy Policy. We may disclose it to companies, registrars, depositories, authorities and professionals as needed to carry out your instructions, or when the law requires. You agree that we may share your information as reasonably necessary to carry out your instructions.
9. Intellectual property
The Website and its content — including the MoneyClaim name and logo, text, graphics and design — belong to us or our licensors and are protected by law. You may view and print pages for your personal use. Any other use needs our prior written permission. Documents you provide to us remain yours.
10. Limitation of liability
To the fullest extent permitted by law:
- the Website and its content are provided “as is” for general information;
- we are not liable for losses caused by delays, rejections, errors or decisions of third parties, or by inaccurate or incomplete information or documents supplied by you;
- we are not liable for indirect, incidental or consequential loss, or loss of profit or opportunity;
- our total liability to you for any claim relating to the Services is limited to the fees you paid us for the matter giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded by law — including liability for fraud or wilful misconduct — or limits your rights under the Consumer Protection Act, 2019.
11. Indemnity
You agree to compensate us for loss and reasonable costs arising from your breach of these Terms, from false or forged information or documents you give us, or from a third party’s claim that arises because of your misstatement.
12. Suspension and termination
We may suspend or end the Services — with notice where practicable — if you breach these Terms, give false information or documents, fail to cooperate, or if continuing would be unlawful or unethical. Termination does not affect rights and obligations that have already accrued. On termination we will return your original documents and, subject to payment of amounts due, hand over the work product relating to your case.
13. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, including acts of government or regulators, changes in law or procedure, portal or system downtime, strikes, natural disasters, epidemics, and failures of utilities or communication networks.
14. Governing law and disputes
- These Terms are governed by the laws of India.
- Talk first. If you have a complaint, write to info@moneyclaim.in and we will try to resolve it within 30 days.
- Arbitration. Disputes not resolved this way will be referred to a sole arbitrator appointed by mutual consent under the Arbitration and Conciliation Act, 1996. The seat and venue will be Bengaluru, and the language English.
- Courts. Subject to the above, the courts at Bengaluru, Karnataka have exclusive jurisdiction.
- Your statutory rights. Nothing in this section prevents a consumer from approaching a Consumer Commission or exercising any right that cannot be waived under the Consumer Protection Act, 2019.
15. General
- Changes. We may update these Terms from time to time; the “Last updated” date shows the latest version. For existing engagements, the Terms in force when you engaged us apply unless you agree otherwise.
- Entire agreement. These Terms and your written engagement form the entire agreement between you and us on their subject.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Delay in enforcing a right is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms without our consent.
- Notices. We may notify you by email, WhatsApp or post to the details you gave us; you may notify us at the contact details below.
